Parenting & timesharing

Focused on Family | Committed to Results

Parenting disputes can affect the routines and relationships at the center of your child’s life. DM LAW helps parents approach those decisions with preparation and a clear understanding of their goals.

Parenting plans and daily life

We work with clients on parenting schedules, communication, school and health-related concerns, and the practical details that help a plan function in everyday life.

Paternity and changing circumstances

We assist with paternity matters and requests to change existing parenting arrangements. We take time to understand the current situation, the history of the case, and the concerns driving the request.

A case grounded in the facts

We examine relevant records and communications and help you prepare to explain your concerns clearly. We pursue workable agreements and advocate in court when disputes remain.

YOUR FIRST CONVERSATION

What to have in mind.

You do not need every answer before calling. These details can help frame the conversation:

  • Current parenting plans and court orders
  • A general outline of the child’s schedule
  • The specific concerns you want to discuss

Our staff can explain how to provide documents after the initial intake and conflict check.

COMMON QUESTIONS

Answers for the decisions ahead.

Does Florida presume equal timesharing?

Generally, Florida law creates a rebuttable presumption that equal timesharing is in a child’s best interests, subject to the statute’s exceptions and the parties’ agreement. It is not an automatic outcome in every case. We help parents evaluate an equal schedule or present evidence supporting a different arrangement.

What if a 50/50 schedule is not best for my child?

The presumption may be rebutted by a preponderance of the evidence. The court considers the child’s best interests and the relevant statutory factors. DM LAW reviews records, communications, witnesses, and daily-care concerns to prepare a fact-based case.

What should a parenting plan address?

A workable plan addresses daily care, timesharing, school and health decisions, communication, and the practical arrangements that fit the child’s needs. We help identify details that can reduce uncertainty and future conflict.

Can an existing parenting plan be changed?

Modification generally requires a substantial and material change in circumstances and a finding that the change serves the child’s best interests. We review the existing order, what has changed, and the specific relief you want the court to consider.

Can you help with paternity and parental rights?

Yes. DM LAW assists with paternity matters and related parenting, timesharing, and support concerns. Bring any existing orders and information about pending cases so we can discuss how the issues fit together.

How do you approach cases involving children with special needs?

We consider how medical care, educational services, therapies, daily routines, and long-term planning affect the proposed arrangements. The goal is a plan that addresses the child’s actual needs and the practical responsibilities of each parent.

Can you help with termination of parental rights?

DM LAW handles parental-rights matters, including termination proceedings. Termination permanently affects the legal parent-child relationship and is different from a timesharing dispute. The requirements depend on the type of proceeding, including whether adoption or dependency law applies. We review the case history and legal framework before discussing available options.

How do you prepare a contested parenting case?

We focus on the child’s circumstances and the evidence that explains them: schedules, relevant records, communications, and witness testimony. We pursue workable agreements where possible and prepare to advocate in court when disputes remain.
