You do not need every answer before calling. These details can help frame the conversation:

  • Your immediate concerns and long-term priorities

Our staff can explain how to provide documents after the initial intake and conflict check.

COMMON QUESTIONS

Answers for the decisions ahead.

Do I have to prove fault to get divorced in Florida?

Florida permits dissolution when a marriage is irretrievably broken; proving misconduct is not ordinarily required to end the marriage. Financial and parenting questions still require careful attention. DM LAW helps identify the issues that must be resolved before a final judgment.

How is divorce different when children are involved?

In addition to property, debts, and any alimony issues, parents must address a parenting plan, parental responsibility, timesharing, and child support. We help connect the financial decisions with the practical needs of your children and household.

Can an uncontested divorce be completed in about 90 days?

That may be possible in an appropriate case, but it is not a guaranteed deadline. Agreement on all issues, complete paperwork, and the court’s schedule affect timing. Florida generally requires at least 20 days between filing and final judgment, subject to a statutory exception. We review whether an uncontested approach fits your circumstances.

Can agreeing on the terms reduce the cost?

An uncontested case may require less work than a contested case and can sometimes be handled for a reduced fee. We review your agreement, identify unresolved issues, and discuss the scope and cost of representation before you decide how to proceed.

How are property and debts divided?

Florida separates nonmarital property from the marital estate and starts with equal distribution of marital assets and liabilities, unless the statutory factors justify a different result. We examine ownership, account records, debts, and valuations to help develop a supported position.

What if a house was owned before the marriage?

Title alone may not resolve every issue. Payments of mortgage principal with marital funds, improvements, and qualifying appreciation can create a marital component. These cases may require historical records and valuations. DM LAW examines the facts under Florida’s equitable-distribution framework, including issues commonly associated with Kaaa v. Kaaa.

Is alimony automatic?

No. A request for alimony requires consideration of need, ability to pay, and the applicable statutory factors. Florida recognizes temporary, bridge-the-gap, rehabilitative, and durational alimony. We review the financial circumstances and the type of relief that may be appropriate.

What if financial records are missing or the case cannot settle?

Tell us which documents you have and what is missing. We help identify the information needed to evaluate income, assets, and debts. If negotiation does not resolve the dispute, we prepare the records, witnesses, and arguments needed to present your position in court.
